Amendments to the Canadian International Trade Tribunal Procurement Inquiry Regulations

On December 15, 2025, amendments to the Canadian International Trade Tribunal Procurement Inquiry Regulations (Regulations) came into force. The Regulations Amending the Canadian International Trade Tribunal Procurement Inquiry Regulations (SOR/2025-0247), along with the Regulatory Impact Analysis Statement, were published in Part II of the Canada Gazette on December 17, 2025.

The Regulations have been amended to specify, in new section 4.01, that the Tribunal shall not address or examine matters relating to any measure in the procurement process that:

  • restricts participation in the procurement process to Canadian suppliers or favours Canadian suppliers;
  • requires or favours the supply of Canadian goods or services;
  • requires or favours the use of Canadian materials;
  • requires or favours the use of Canadian subcontractors;
  • requires bids to provide benefits for Canada or include a minimum Canadian value-added or favours bids based on the benefits for Canada they would provide or their Canadian value-added;
  • restricts participation to small businesses.

The Regulations have also been amended to add a condition that must be met for the Tribunal to conduct an inquiry into a complaint, by specifying that the complaint must raise matters that are not set out in section 4.01. The amended Regulations also provide that if the Tribunal conducts an inquiry into a complaint, it must determine, subject to section 4.01, whether the procurement was conducted in accordance with the provisions of the applicable trade agreements.

The transitional provisions specify that the amendments apply in respect of a complaint that is filed on or after December 15, 2025, and for which the Tribunal has not made a determination.
